Overview
Hayden is Of Counsel with Hirsch & Ehlenberger and is proud of his work helping individuals and their families throughout Northern Virginia and the District of Columbia.
Hayden is adept at resolving all types of family law disputes through negotiation, mediation, arbitration, and the Collaborative divorce process. When necessary, Hayden draws on extensive litigation experience and diligent preparation to provide effective advocacy in court.
Hayden has significant experience representing individuals in military divorces, international and multi-state jurisdiction cases, high net worth disputes, contract enforcement and rescission disputes, custody disputes involving children with special needs or disabilities, cases involving parties with alcohol, substance abuse, or mental health problems, as well as complicated equitable distribution and spousal support matters.
Hayden regularly prepares and negotiates prenuptial agreements for all types of clients, and also frequently advises clients participating in mediation with third-party mediators.
Hayden has received accolades from clients and attorneys alike. He was selected to Super Lawyers in 2024, 2025, and 2026 – an honor reserved for only 5% of attorneys – and was previously named as a Super Lawyers “Rising Star” from 2018 to 2022. He has also been rated “AV Preeminent” – the highest Martindale-Hubbell attorney rating for professional excellence – by fellow attorneys in Virginia and the District of Columbia.
He is currently the co-chair of the Fairfax County Circuit Court Domestic Relations Subcommittee, which works to improve family law court practice and procedure. He is also a former a board member of numerous bar groups, including the Fairfax Law Foundation, the Virginia Trial Lawyers Association (as former Chair of the Young Lawyers Division), the Collaborative Professionals of Northern Virginia, and the District of Columbia Academy of Collaborative Professionals.
Immediately after law school, Hayden was privileged to complete a one-year, full-time judicial clerkship for two Virginia Circuit Court judges. Since that time, Hayden has engaged exclusively in private practice.
When he’s not practicing law, Hayden enjoys spending time with his family, cooking, collecting vinyl records, and cheering for the Virginia Cavaliers.

Some lawyers publish comparative information regarding the services that they provide which may be subject to specific comparative communications restrictions.
How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
