Attorney Information

Overview

Mahlon’s practice focuses on trusts and estates and civil litigation. He represents individuals, families, beneficiaries, fiduciaries, and businesses in matters involving estate planning, wills and trusts, probate, estate administration, contested estates and trusts, fiduciary disputes, and civil litigation.

Estate Planning and Drafting: Mahlon assists individuals and families with the preparation and implementation of estate plans designed to address family circumstances, disposition of property, incapacity, fiduciary decision-making, and the administration of assets after death. His estate planning practice includes the preparation and review of wills, trusts, powers of attorney, advance medical directives, and related documents. Depending on a client's circumstances and objectives, planning may also involve the use of revocable trusts, beneficiary designations, property ownership arrangements, provisions for minor or dependent beneficiaries, strategies for the management and distribution of assets, and business succession plans.

Probate and Estate Administration: Mahlon represents executors, administrators, trustees, beneficiaries, and other interested parties in the administration of estates and trusts in Virginia. His practice is informed by experience on both sides of the trusts and estates process. In addition to representing clients in private practice, he previously served as a Staff Attorney in the Office of the Commissioner of Accounts for Fairfax County, where his work involved Virginia estate, trust, probate, and fiduciary matters. That experience provided substantial exposure to the legal and practical issues that arise in the administration of estates and trusts, fiduciary accountings, creditor claims, disputed distributions, and contested proceedings.

Will Contests, Trust and Estate Disputes, and Fiduciary Litigation: When disagreements concerning an estate or trust cannot be resolved privately, Mahlon represents beneficiaries, heirs, executors, administrators, trustees, and other interested parties in contested litigation.

Civil Litigation: In addition to his trusts and estates practice, Mahlon represents individuals and businesses in civil litigation throughout Northern Virginia. Before concentrating his practice more substantially on trusts and estates, Mahlon's private practice focused heavily on litigation. He has experience with disputes in both state and federal courts and with matters proceeding from initial investigation and pre-suit negotiations through pleadings, discovery, motions practice, evidentiary hearings, trial, and post-judgment proceedings. His civil litigation practice includes disputes involving contracts, businesses, property, financial obligations, and other commercial and individual civil matters.

While admitted to practice in Virginia, the District of Columbia, and New York, Mahlon primarily practices throughout Northern Virginia including, but not limited to: (i) Fairfax County, (ii) Prince William County, (iii) Loudoun County, (iv) Arlington County, (v) Stafford County, (vi) the City of Alexandria, and (vii) Spotsylvania County.

Before joining Odin, Feldman & Pittleman, P.C., Mahlon served as a Staff Attorney in the Office of the Fairfax County Commissioner of Accounts. Mahlon also teaches legal writing

courses at the Antonin Scalia Law School. While earning his J.D., Mahlon served as Managing Editor of the George Mason Law Review and as the Extramural and Mooting Chair of the Moot Court Board.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
