Mark R. Baumgartner - Virginia Beach, VA

Mark Baumgartner focuses his practice in the areas of corporate and transactional law, real estate, environmental law and litigation.

Mark works with business owners, particularly entrepreneurs, landowners and developers, to manage their relationships with business partners, customers, vendors and government agencies. He identifies and analyzes specific issues, challenges and opportunities presented in each relationship to counsel his clients to make the smartest business decisions and develop necessary legal documents to protect his client's best interests. When necessary, Mark will aggressively defend and preserve his clients' rights through litigation.

Mark served in the United States Marine Corps from 1982 through 1986, operated an import and wholesale distribution company from 1991-1997, and was a United States Coast Guard Licensed Merchant Marine Officer from 1987 to 2002.

REPRESENTATIVE CASES & TRANSACTIONS

Helped business owners start new ventures, buy and sell existing businesses, including independent businesses and franchises.

Represented landowners in acquiring property, structuring business ventures, obtaining necessary local, state and federal permits, and reselling or leasing the improved property.

Successfully represented landowners whose land was improperly designated as ‘wetlands' by the U.S. Army Corps of Engineers and assisted in obtaining permits necessary to impact wetlands to obtain the full benefit and value of the property.

Represented the minority shareholder treated unfairly by a majority shareholder and obtained significant compensation for the minority shareholder.

Carefully structured a seller-financed business sale allowing the seller to quickly foreclose when the buyer was unable to continue making payments. The quick and efficient foreclosure allowed the seller to rebuild the business and recover what could otherwise have been a significant loss.

Obtained a judgment of over $500,000 in favor of an artist client for work copied without permission.
