Overview
Born in 1949 to the late Tom H. Peyton and Anne T. Peyton, Mr. Peyton is a lifelong resident of West Virginia
A native of St. Albans, West Virginia, Harvey D. Peyton was admitted to practice law in the State of West Virginia immediately upon graduation from the West Virginia University College of Law in 1974. After a one-year clerkship with Chief Judge Robert E. Maxwell of the United States District Court for the Northern District of West Virginia, Mr. Peyton began practicing in the law office of Andrew J. Goodwin with a concentration on insurance defense trial work. In 1977, Mr. Peyton began practicing in Nitro, West Virginia, representing a wide range of civil litigants. Currently, he concentrates his practice on plaintiffs’ civil and criminal defense trial work in the Circuit Courts of Kanawha, Putnam and Mason Counties of West Virginia, and in local federal district courts. He is a member of the Putnam County Bar Association, the West Virginia State Bar, the West Virginia Bar Association, the West Virginia Association for Justice and the American Association for Justice. He is a past president of the West Virginia Association for Justice (formerly the West Virginia Trial Lawyers Association) and the West Virginia Bar Association. During a career that has now spanned almost 50 years of active practice, Mr. Peyton has completed well over two hundred jury trials involving wrongful death, serious personal injury, business disputes, claims under the Federal Employers Liability Act and criminal matters ranging from burglary and robbery to first degree murder.
Mr. Peyton believes that one’s highest goal is to help others who may be less fortunate. With his latest gifts to WVU and other institutions, the value of Mr. Peyton’s charitable gifts has exceeded a million and a half dollars.
Mr. Peyton is married to the former Jennifer Bailey of Poca, West Virginia, a graduate of Marshall University. He is the father of three children, Tom, Sarah and George, two of whom studied at WVU and all three of whom graduated from Marshall University.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
