Review of Weiner Law Group’s Malpractice – San Diego Superior Court Case #25PT001388C We retained Weiner Law Group to protect our mother, Charlene C. (the protected elder), by removing her abuser — our sister — from any position of control. We worked with attorneys Claire Linden, Christopher Fortunati, Geoff Farwell, and firm owner Daniel Weiner. All claimed excellent representation. Despite more than $35,000 in fees and over a year of representation, the firm delivered zero substantive progress. They repeatedly cited low funds needing replenishment, claimed “these cases take time,” and dismissed judicial criticism as normal. We promptly provided compelling evidence: photographs of biohazard conditions (cat feces and urine caked on floors, furniture, windows, and mattress), medical neglect, no food, our mother wandering in 55 mph traffic, EMTs declaring the home unlivable, HHSA refusing to release her back into the abuser’s care, and over $240,000 missing from the trust. The firm never filed a proper emergency Ex-Parte application to remove the abuser. Their submission was so deficient that the judge treated it as routine discovery rather than an urgent request for protection. In stark contrast, we — with no legal training — filed our own Ex-Parte application using the exact same evidence the firm had from day one. It was accepted and secured an emergency hearing scheduled for July. We accomplished this in under one week at a cost of less than $1,000. The firm’s inaction nearly forced us to abandon the fight, depleted our family’s resources, and allowed the abuser to retain control while the trust continued to be drained. At the hearing to close the case, the judge herself confirmed that no genuine emergency action had ever been properly pursued. Both the State Bar of California and Judicial investigations have been accepted and are underway, based on sufficient evidence of malpractice. A firm specializing in trusts, probate, and elder protection achieved nothing in over a year and $35,000+. The clients obtained real progress in days using the identical evidence. Case #25PT001388C (San Diego Superior Court). Search the public Court Index: (enter 25PT001388C). A former employee Glassdoor review (Jan 2025) describes high turnover and chaos — consistent with our experience. Weiner Law Group prioritized billings over our mother’s safety. Examine the complete record before retaining them. P.S. accidentally submitted this before with a broken email address... please delete that one, it is identical to this one and this email address is not broken.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
