I hired Marc to represent me in both an arrest for Domestic Violence & because my wife and I filed petitions for Domestic Violence Restraining Orders against each other. Marc persuade the District Attorney to not file a criminal case against me. After seeing how Marc fought for me in court, my wife hired her own lawyer for the DVRO case. I specifically hired Marc because the outcome of a DV arrest & a DVRO case can negatively affect my future as an officer in the US Coast Guard. Marc fought for me at every hearing and my wife had a tough lawyer, as well. I am impressed with how he represented me so far.

I know Marc for several years. Despite the fact I was his first client he represented before the Office of Chief Trial Counsel for the State Bar of California, I hired Marc because I knew I could count upon his dedication and professionalism. We continue to work together. I made the right choice.

Thank you for sharing your words of positive feedback. I represent clients in various professional licensing matters with the relevant State of California agencies regulating professional licenses. You did the right thing by hiring an attorney as soon as possible to protect your professional license. Happy Holidays!

We initially hired Marc more than a year ago for some related Civil Harassment Restraining Order cases against one of us. Marc then provided us with the option to file for restraining orders against the neighbors using Elder Abuse restraining order petitions. Unfortunately, despite Marc good work, the judge did not agree with us. Some of the neighbors persisted with the harassment and Marc stuck by us in filing two more Elder Abuse restraining order cases against them. However, even with the stronger evidence, the Judge would not side with us. We feel Marc still did a very good job and that it is not always possible to win cases in court even when a lawyer does his work correctly.

I appreciate your positive feedback. It was a pleasure representing you and becoming your family's lawyer! Unfortunately, we do not always win in court even when the client and lawyer do their respective roles correctly because in the end it is all up to the judge. Wishing you and your family a Happy Holidays!

I hired Marc Pelta for a DUI case. He is representing me before both the DMV and the San Mateo County District Attorney. So far I am pleased with his representation, guidance and advice in this stressful process. He puts me more at ease when explaining my rights and the plan he has to protect them.

Thank you for your feedback! It was a pleasure representing you in San Mateo County for your DUI. It is important to me that a client understands the criminal justice process. Being proactive as you were by hiring me in time to handle your DUI case with the DMV and DA was the right move to make. That gives you at least some measure of control about the outcome regardless of what it will be. Wishing you and your family a Happy Holidays!

Firm Information

Overview

Pelta Law was established by former prosecutor and veteran criminal defense attorney Marc Pelta to use his past training & experience as a prosecutor with the DA combined with his more than a decade of criminal (& juvenile) defense experience to champion the rights of his clients even in Restraining Order cases.

Marc uses his specialized knowledge and skill to fight for clients in criminal and restraining order cases that include:

  • DUI
  • Domestic Violence
  • All Misdemeanors
  • All Felonies
  • Civil Harassment
  • Restraining Orders
  • Elder Abuse
  • Professional Licensing Board Investigations

Marc is a tough litigator with extensive trial experience should a case need that option, whereas most lawyers do not offer that. This sharply differs from the approach of many attorneys who often encourage clients to agree to unfavorable deals or settlements in order to avoid going to trial or just to end the case sooner and move on to the next client's case.

Marc analyzes each client's case with a sharp eye while keeping in mind what the prosecutor's perspective may be in order to get the best possible deal for the client or the best possible victory from fighting the case in court in front of a judge.

Some lawyers publish comparative information regarding the services that they provide which may be subject to specific comparative communications restrictions.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
