Ninety Nine Investments, Ltd. v. Overseas Courier Service (Singapore) Private, Ltd., 113 Cal. App. 4th 1118, 6 Cal. Rptr. 3d 891 (2003). In this case the Court of Appeal held in favor of purchaser, which brought action for specific performance of a real estate purchase and sale agreement against seller, holding that substantial evidence supported a finding that the seller’s failure to timely comply with escrow obligations prevented loans from funding by closing date and thus excused the purchaser’s performance under the agreement.
