Hired Law firm 2021I had hired Alison Zinn at Lathrop GPM - Denver To contest my stepfather’s will/trust when I found out upon his death that he had changed it prior to his death but 22 years after the initial one was written. (This was a multi million dollar estate, part of which was a few million dollars my stepfather had received when my mom passed away 13 years prior.) I believed he had changed it due to undue influence and lack of testamentary capacity and we needed medical records to prove the latter. Alison gave me hope of at least a settlement and had told me that people settle all of the time. I had asked her to start the process so that we can get copies of my stepfather‘s medical records. However, she did not do that. Instead, after she had spoken with the other attorney (My stepfather’s attorney who was handling his estate), Alison did a complete 180 and told me that my stepfather had every right to change as will. First of all, if that were true, why didn’t she tell me that from day one instead of asking for a $2500 retainer. That would be unethical to take someone’s money to contest a will if there was no ground to contest a will and if people are allowed to change their wills for no reason at any time. If that were the case, then the right to contest a will would not exist. However, the right to contest a will does exist and people are able to contest wills based on undue influence, lack of testamentary capacity, etc.. After Allison had spoken with the opposing attorney, She did a complete reversal of what she had previously told me when she said there is a possibility of a settlement, that people settle all the time. We already knew that undue influence by my stepfather’s new wife and biological children would be tough to prove…. It’s tough to prove what was said in private…. but we needed medical records to prove lack of testamentary capacity. This was a case I believe in which lack of testamentary capacity would have been easy to prove if I had been able to obtain my stepfather’s medical records. I believe my stepfather may have had dementia or Alzheimer’s especially since he had sent me a Birthday check around the same time that he had changed his will / trust and wrote Merry Christmas on the check - in the month of May! Instead, Alison Zinn had told me that the other attorney had told her that my stepfather was of sound mind when he changed his will / trust. First of all, the other attorney is a lawyer, not a doctor, so he most likely does not know his clients medical issues. Secondly I cannot believe that Alison would take the word of the other attorney instead of relying on actual medical records that I had asked her to obtain for me. I am at the very least flabbergasted by this! What kind of attorney would take the word of the attorney for the other party on health issues, Or anything else for that matter, instead of relying on actual medical records / facts? The word of someone else, especially if that is not their field of specialty, is not a fact. I had one shot at this and unfortunately I trusted this attorney and this firm to do as I had requested and to help me contest my step-fathers will / trust and to help me obtain my step-father’s medical records and they did neither. I find it very strange how Alison changed her tune after speaking with the opposing attorney and again, why she didn’t help me get my stepfather’s medical records and just took the word of the other attorney that my stepfather was of sound mind. When I filed a complaint with Lathrop GPM corporate, I was told that I was well represented. I cannot believe that taking the word of the other attorney and not doing what I had initially requested, was being well represented. I’m pretty sure that’s a case for a lawsuit as well.
