Hired Attorney 2015Very Bad Experience: Jason posed as my advocate while he swindled thousands from me. I hired Jason to address a specific item. He filled time with tasks that did not need to be done nor for which I asked, he did not accomplish the task I requested, and then, when I refused to pay, he took the money from a retainer my mother had provided for unrelated work of hers. I was referred to Jason and he seemed confident and friendly. My situation was simple. Unknown to me, a lien and freeze order were placed on property I was trying to sell. I had received an offer, discovered the obstacle, gave the buyer's contact info to Jason, and asked him if he could satisfy their requirements to buy the property. Jason later answered that he could take care of it so I hired him. Later, Jason told me he completed. When I tried to proceed with the buyer, I discovered Jason had not reached out to him and had not satisfied the buyer's requirements. The buyer was not willing to purchase (understandably so), unless the freeze order and lien were removed. Jason only removed the lien. I asked Jason why. Jason said he was unable to remove the freeze order. I asked why he spent any time at all (especially going to court) if he knew from the start that he wasn't going to be able to satisfy the buyer. He said he didn't know the buyer wouldn't purchase if the freeze order was still in effect. I asked Jason why his first step wasn't simply to call the buyer and ask. He didn't have a response other than I needed to pay him. I refused to pay Jason and he took the money out of a retainer my mom had with him for unrelated work. I consulted another lawyer who confirmed what Jason did was wrong, however, it was also explained utilizing legal resources to recover what he stole would be a net loss.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
