    Hired Attorney 2013-2014
Anderson & Associates had represented me in my divorce case back in 2013-2014. Since that time, my ex-husband has made very inconsistent payments towards child support and has also failed to provide any new employer or pay information. Now that his most recent employer has been located, I recently had court in February of 2020 to modify the Support Order based on his current salary, for the first time since our divorce, while also completing an Account Adjustment Review to correctly calculate his arrears. While preparing for court, I noticed a discrepancy between what I had signed on our Marital Settlement Agreement in 2014 and what was written on the Order for Support and filed in court that same day. I then went to the DuPage Courthouse and reviewed our MSA that was entered in court in 2014, and I noticed the arrear payment amount that I had agreed to receive was crossed off and changed after the MSA had already been signed. This change was not only done without my consent, but it has caused me to receive much less money towards arrears over the years and has continued to affect the amount of arrears I currently am receiving with each payment today. I went directly to the Anderson & Associates office in Wheaton, IL on 11/6/2019, the day I noticed this discrepancy, and was told that they did not make this change and blamed it on my ex-husband's attorney. I then spoke to my ex-husband's attorney that same day who said he did not make this change, and who also pointed out that the handwriting used to make the change on the MSA and Order for Support was the same handwriting as the Anderson & Associates employee that put together the entire Order for Support document. As I was not present in court on the day my divorce was to be finalized, due to the advice of my attorney at Anderson & Associates at the time, I pulled the court transcripts from that day, which show no indication or discussion requesting any changes to be made within the already signed MSA or Order for Support. Also, the support amount agreed upon within our MSA was well under 65% of my ex-husband's disposable income at the time. With all of this being said, I have been emailing and calling Mr. Jonathan Anderson since 11/7/2019, with no response, until today, 3/23/2020. He finally answered my call to tell me why his firm has not made any mistakes, telling me the Judge must have crossed off the amounts within the already signed agreement, argued and talked over me for 30 minutes without allowing me to speak, and then told me I could fix this mistake by hiring another attorney. After pleading to be heard, he then stated that his hourly rate is $400 per hour and that he will not talk to me for free and if I want to sue him, I can try, and then hung up on me. This attorney should be disbarred and anyone needing a divorce attorney should definitely avoid this firm.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
