Hired Attorney 2024In an attempt to deflate an ongoing dispute between my new neighbors regarding my pets, my wife and I reached out to the homeowners association attorney, Cynthia Hitt Kent, on October 9, 2024. She did not respond to our voicemail. On or about November 7, 2024, we received a letter from Ms. Kent via United States Postal Service, first-class mail. The four-page letter did not acknowledge receipt of our voicemail message nor our concerns. Instead, she made a unilateral decision to engage in biased behavior towards us. Her misconduct of ineffective communication has harmed us. In the letter, Ms. Kent was disrespectful, ignited hostility, and elevated tension and animosity. As such, we responded to her letter on November 8, 2024 by email. Given that the tone of Ms. Kent’s letter raised questions about her attempt to mediate impartially, we asked that she NOT contact us further. On November 25, 2024, we received ANOTHER first-class letter from Ms. Kent. Her blatant disregard of our request is unprofessional and disturbing. She’s racking up additional and unnecessary attorney fees for the sake of annoyance. Her fee is paid using our HOA annual dues and that of our neighbors. We are prayerful her intimidation ceases.

Hired Attorney 2015-2024As background, for the past three years, I have been dealing with new neighbors in our community who have lodged several false allegations against me via the homeowners association (HOA) and County Animal Control regarding our pets. The affidavit of the numerous animal control complaints alleged by the neighbors have not been signed by affidavit. I have video surveillance which counters their claims. Regarding the complaints made to the HOA, I was not given due process, and have asked for a board hearing so that I can provide evidence to disprove the neighbor’s baseless claims. In a desperate attempt to have open communication and resolve the dispute, I contacted the HOA attorney, Cynthia Hitt Kent, on October 9, 2024 at 2:39 p.m. and left a 1-minute, 10-second voicemail regarding the issue. She never returned the call. On or about November 7, 2024 I received a 4-page letter via first class postage from Attorney Kent. The letter was grossly insulting, misrepresented the facts, and void of her obligation to investigate BOTH sides making the dispute resolution process unfair. In the letter she stated, “At this time, the Board of Directors, is closing the file on these complaints.” I responded to Attorney Kent via email on November 8, 2024 and stated, "Ms. Kent, this letter serves as notice to cease and desist all further communication with us in regard to any matter. Any correspondence received from you or your office will be deemed harassment.” On November 26, 2024, I received another letter from Attorney Kent for which her professionalism continues to be in question, and her impulse to respond uncivilly is appalling. Her unwanted response did not provide additional, nor useful information. Again, Attorney Kent stated, “In case the letter is not clear, the file is closed on this matter.” As of December 11, 2024, THE CASE REMAINS OPEN!! I do not want Attorney Kent to further harass me or continue to bill my neighbors (HOA) for a case that is “closed”.
