Mr. Evans , was an arbitrator in a civil litigation case for our company. Even though he found in our favor 90% it was travesty. Since his ruling I have consulted with 2 additional firms as well as our council ,Foley & Larder and its unanimous that : 1. Evans went off four corners of the complaint creating another cause of action that was not plead. 2. He was wrong in doing so. 3.He was arrogant and unwilling to rectify a number of mistakes. 4.He misquoted testimony. 5. Instead of making a ruling he left it up to a known bill board lawyer and F&L to determine damages that were clearly not plead. He created a new cause of action that was plead to give the plaintiffs something when they deserved nothing by law. In addition he award legal fees to plaintiffs and denied our companies fees even though we were vindicated. Evans could have awarded our attorney fees which were substantial but simply chose not too. Cam Evans failed miserably in his duty and was sympathetic to plaintiffs who actually fell asleep during the arbitration , and also perjured themselves which was clear in the if he had bothered to compare testimony to their deposition. I would never under any circumstance recommend Cam Evans as an arbitrator.
