I like most, have been impacted by Covid. I contacted Lyons, Doughty, and Veldhius following a letter I received regarding a Capital One account. We agreed on a settlement amount, and I inquired of the most efficient way to pay. Since the office accepts on-line payments and I would have gathered this would have been the most efficient, but no. The rep stated a cashier’s check mailed to the office would be the fastest way to settle the account. So, i purchased a cashier’s check and mailed it priority mail (an extra $23). Since the mail went out on Saturday, LDV received the check the following Monday. I received a call from a rep stating the check was received, but I wrote on the check that debt was "paid off" not “settled” and they can send a letter only stating the debt was "settled". I said okay and asked the rep to email a letter verifying the debt is indeed "settled". I was informed they can only mail or fax, so two days later, I received a fax only detailing the settlement agreement, not “settled”. This is where I’m annoyed. After receiving the faxed settlement agreement letter, I called LDV to inquire why the letter did not inform of the payoff. The representative DeAnne (ext. 4153) informed me it was my fault for not asking for a payoff letter but requesting a settlement letter. She went on to say, if you asked for the correct letter, we would have sent the correct one. LDV took no responsibility. What a poor excuse for customer service.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
