    Hired Attorney 1982-1983
I had Eric Naiburg as my attorney for a 1982 case of second degree murder, first degree manslaughter and criminally negligent homicide. Though he presented the fact pattern and case law is a criminally negligent homicide case and that I would do no more than five to six years he stated that I should take a plea to second-degree murder and I should be out in five or six years . I listened to the jailhouse lawyers who tell me he was full of crap but my family said to listen to the lawyer since he knew what he was doing . I ended up entering a play to second degree murder , and prior to the murder had been coached by nyberg how to answer questions that were going to be asked to me by the judge . Upon giving my allocution I was remanded back to the jail for sentencing . I went back to the courthouse believing I would be sentenced to 5 to 6 years when in fact I had been given a 15 to year life sentence . I attempted to withdraw my play only to be denied since I plead guilty . Upon questioning nyberg later on in letters , which I still have , he stated that I did receive a benefit by taking the plea . I only wish I knew what benefit I received since they all knew in the court there was no intent and No Malice in what I had done only I acted carelessly . So if you have any legal action pending against you, I highly suggest not to hire Eric Naiburd. Remember, he was the same scoundrel that had the affair with Amy Fisher when he was defending her in court against Joey Buttafuoco. Eric neighbor cannot be trusted and will steal your money legally. have to do research and taking and accepting the play I found out it's all a lie. He cannot be trusted and he will sell you out to get a better deal for another client.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
