  • By Scott W. on Mar. 06, 2019
    Hired Law firm 2018-2019
My ex fiancé’s father hired Peter Stambleck of Aronson Mayefsky & Sloan, with Alexandra (Ali) C. Franco assisting to draft and negotiate a prenuptial agreement between my fiancé and I. Most of the prenuptial agreement was ok, and I say ok, as it was underwhelming in terms of covering issues of importance (which will result in higher legal fees if a divorce occurs potentially) and potentially contentious were the marriage result in a divorce and this agreement were necessary to assist in the dissolution of a marriage. More importantly, however, Mrs. Franco and Mr. Stambleck attempted to insert what seemed to be intentionally, language to create a land grab, literally and figuratively, for my fiancé, should we have separated, “Notwithstanding the foregoing, if the value of Scott’s interest in any of the LLC interests listed on Exhibit B increases as a result of his active efforts, the appreciation of such assets shall be deemed Marital Property.” For someone who is unfamiliar with this language, this could have resulted in my agreeing to create a marital interest in my entire business, despite the business being premarital. The legal standard to my understanding is 1% of appreciation to be ceded to the spouse per year of marriage to compensate for any active involvement by the other spouse in a premarital business, a far ways off from the 50% these lawyers seemingly sought for me to agree to. I believe that whether intentional or accidental, such to be very unprofessional, unethical, and immoral on the part of Mrs. Franco and Mr. Stambleck, and I believe the rest of their negotiating tactics and advisory to my ex- fiancé resulted in the dissolution of our engagement as they sought to limit my fair and equal protection in the creation of a prenup agreement. If you’re looking for attorneys who will, if successful, unfairly protect your interests and overtly try and acquire more than your fair share in a divorce, hire them. If you’re looking for someone who can get you to “Yes” or “I do” in a fair manner, seek counsel elsewhere is my opinion. Unfortunately my ex fiancé and her father didn’t realize I can take on the so called top lawyers at Aronson Mayefsky & Sloan and stand up for myself to not be subverted and taken advantage of even if it resulted in a marriage not being consummated. Think twice if this is the outcome you may want to encounter before hiring this firm.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
