Mr. Gaboury's area of concentration is focused on trademark, copyrights and technology law. Mr. Gaboury counsels clients with respect to the clearance and registration of trademarks, registration of copyrights, technology licensing and other intellectual property related agreements and IP-related litigation in federal and state courts. Mr. Gaboury helps clients cost effectively establish, protect and use intellectual property – allowing them to leverage IP as a competitive advantage to increase profits.
He has conducted numerous proceedings before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office to enforce and defend clients’ trademark rights. In addition, he has successfully handled domain name dispute proceedings brought before the World Intellectual Property Organization in Geneva, Switzerland.
Mr. Gaboury has represented and counseled numerous clients spanning several industry sectors including: computer software and hardware, professional and consumer electronics design and manufacture, the gaming industry, banking and insurance, and domestic and international manufacturing and retail, amongst others. Mr. Gaboury also has extensive experience counseling authors, musicians, designers, and consultants with regard to the protection of the intellectual property embodied by their creative works.
Mr. Gaboury has successfully prosecuted hundreds of federal trademark and copyright registration applications before the United States Patent and Trademark Office and the United States Copyright Office. He provides in-depth counseling to clients as to the proper selection and clearance of trademarks to gain maximum benefits under US and international trademark laws.
Mr. Gaboury also counsels clients with regard to intellectual property licensing and transactions. He drafts and reviews contracts in connection with computer software and hardware licensing, technology consulting, non-disclosure agreements, manufacturing and distribution agreements, media content licensing, publishing, and web site design and creation, amongst others.
In addition to his intellectual property transactional work, Mr. Gaboury also assists clients with intellectual property enforcement and policing. He works closely with clients to resolve disputes with as little attorney-intervention as possible, in an effort to save clients the expense and hassle of litigation. He has drafted and issued dozens of successful cease and desist letters to potential infringers.
