Kody C. Silva, a Founding Partner of Deyerle Silva Smith, PLLC, is a highly skilled and experienced family law practitioner with over a decade of family law experience. Kody is dedicated to providing comprehensive and personalized legal solutions to clients facing complex family law matters.
With a practice focused on divorce, custody, premarital and post marital agreements, pre-litigation consulting, protective orders, and LGBTQ+ family law issues, Kody has gained a reputation as a compassionate and fierce advocate for his clients.
Kody received his Juris Doctorate from Baylor Law School and a Bachelor of Arts in Psychology and Sociology from the University of Nebraska – Lincoln. After law school, Kody worked for the Office of the Attorney General for the District of Columbia and then as an Associate Attorney at the law firm of Ackerman Brown. In 2015, Kody returned to his home state of Texas and began working as an attorney at an Austin-based family law firm, where he became a Partner in 2019.
In 2023, Kody and his fellow Partners, Candice Deyerle and Lianna Garza Smith, founded Deyerle Silva Smith, PLLC to provide excellent family law representation to Austin and the surrounding communities of Central Texas under a shared vision.
Kody is admitted to practice law in the State of Texas and in the District of Columbia.
In addition to his legal practice, Kody is a member of the Austin and Williamson County Bar Associations and he recently finished a six-year term as a member of the Board of Directors for a local non-profit organization, Out Youth.

Hired Attorney 2019-2020When I decided to file for divorce, I googled the "best family attorney" in Austin and got Kirker's firm as one of the top ... well, I did not know that hiring that firm does not mean getting a good lawyer, or an experienced lawyer. I got a very inexperienced lawyer who appeared incompetent and constantly unprepared. Kody did not only lack the basic understanding of how to maximize the gains of his client ... he was consistently unprepared and always reacting to the other party's filings or actions. Everything was a surprise. Always consulting with his "colleagues" on what to do next. The other problem that he had is that he cared about his career more than my or my kids' life & future, which felt like they were on the line in this court fight; The other party's attorney had 30+ years of exp .. he was constantly lying & hiding info & maneuvering ... & while you expect your attorney to protect you from such dishonest behavior ... it felt to me that Kody was either working for him, giving him excuses & building a relationship so he can help him with his career in the future. I changed my attorney after 9 months of useless expenses & effort .. and in 3 months, I ended up with a result that was told to me by Kody as "very unlikely".
