Overview

Benjamin is no stranger to hard work. He grew up in the rural community of Lovelady, Texas. When he was not participating in many of his school related activities, he was working on his family's small ranch or doing work for other ranches in the area. After graduating high school, he began working as a Correctional Officer with the Texas Department of Criminal Justice. Over a 16-year career he moved throughout the state working at maximum security prisons in Huntsville, Rosharon, Tennessee Colony, and Brazoria. During his career with TDCJ he reached the rank of Captain of Correctional Officers on two separate units.

After his career with TDCJ, Benjamin earned a Bachelor of Science degree in phycology from Sam Houston State University where he achieved academic recognition. He was also a member of the school's cognitive psychology research team. He participated in studies dealing with eyewitness memory, in-group out-group bias, and other areas of memory recall. He presented research findings at the Southwestern Psychological Association Conference multiple years.

Benjamin then earned a Doctor of Jurisprudence degree from South Texas College of Law Houston. While at STCL, he again received accolades for academic excellence. He served as a liaison between the Dean and the student body as a member of the Dean's Advisory Board, a position appointed by the Student Bar Association and members of faculty. Benjamin also participated in the Criminal Defense Clinic at STCL working with the Harris County Public Defender's Office.

Benjamin began working with The Gertz Kelley Law Firm during his final year at STCL by assisting in trial preparations, research, and trial activities. He is currently an Associate Attorney with the firm where he has participated in felony trials, hearings, conducted legal research, and formed legal arguments to achieve favorable outcomes for clients. He is capable and eager to assist clients in all areas of criminal defense.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
