Overview
I am an award-winning immigration attorney specializing in complex visa applications, mandamus applications, U.S. district court review of USCIS decisions, self-petitioned green cards, and immigration appeals.
I have won numerous important cases before some of the most powerful courts in the world including the U.S. Supreme Court and the Fifth Circuit Court of Appeals (something very few attorneys can say).
My firm files mandamus petitions in U.S. district court. We regularly succeed in speeding up stuck adjustment of status applications (I-485), family-based petitions (I-130s), I-765s (work authorization), N-400s (naturalization), and asylum interview scheduling. We have filed successful mandamus petitions to get consular cases unstuck from administrative processing. This has worked for non-immigrant cases (like E-2s) as well as immigrant cases (stuck DS-260s). We also get I-829 petitions (for EB5 investors) approved after years of delays and no action from USCIS.
Mandamus isn’t the only thing we can use the federal courts for. We can also appeal USCIS denials of applications and petitions. Just this year we got an E-2 denial overturned for a successful T-shirt business as well as a P-3 denial overturned for a Lebanese musician. The Administrative Procedure Act (APA) often gives the U.S. district courts jurisdiction to review these decisions under 5 USC 706 if they are “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law;” or “without observance of procedure required by law.”
We also file habeas petitions in federal court and have successfully gotten bond (or outright release) for many, many people detained unjustly under Matter of Yajure-Hurtado.
I also have significant experience in all types of employment-based petitions, both non-immigrant and immigrant. We handle TNs, H1Bs, L’s, O1s, E’s, and changes of status (including for visitors and students). We also handle motions to reopen/reconsider (I-290B) internally with USCIS, when that is the right course.
